Terms & Conditions

Overview

Any new features that augment or enhance the current Service, including the release of new tools and resources, shall be subject to these Terms of Service. Continued use of the Service after any such changes shall constitute your consent to such changes.

Violation of any of the terms below will result in the termination of your Account. Agam Technologies prohibits conduct that violates these terms and you agree to use the Service at your own risk.

Basic Terms

• If you do not agree, you should decline this Agreement and immediately stop using the Service. Access is permitted only to those who fully agree with these Terms.
• This Terms of Service Agreement shall be exclusively governed by the laws of the Republic of India. The exclusive jurisdiction for any dispute resolution is the Pune District Court, Maharashtra, India.
• We may modify the Terms upon notice at any time. If significant changes are made affecting your rights, you will receive at least 30 days advance notice via email.
• You must provide your legal full name, a valid email address, and any other information requested to complete the signup process.
• Your login may only be used by one person — a single login shared by multiple people is not permitted. You may create separate logins for as many people as your plan allows.
• You are responsible for maintaining the security of your account and password. Agam Technologies cannot be liable for any loss or security breaches resulting from your failure to comply with this obligation.
• You are fully responsible for all content posted and all activity that occurs under your account.
• You may not use the Service for any illegal or unauthorised purpose, including violation of copyright laws.
• The Client undertakes not to harass, threaten, abuse or harm the Service Provider or other users of the Service in any way.
• Your use of the Service is at your sole risk. The service is provided on an "as is" and "as available" basis.
• Technical support is only provided to paying account holders via email.
• You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service without the express written permission of the Service Provider.

Limitation of Liability

The Service Provider does not represent and warrant that:

• Your use of the Service will meet your specific requirements
• The Service will be uninterrupted, timely, secure or error-free
• Information obtained through the Service will be accurate, correct and reliable
• Defects in the operation or functionality of the Service will be corrected

The Service Provider is not liable for any direct, indirect or consequential damage including loss of profit, data, goodwill or business reputation resulting from changes, interruptions, deletion or corruption of data, or failure to maintain account security.

Refunds, Upgrading and Downgrading

• The Service is non-refundable. There will be no refunds or credits for partial months of service, upgrade/downgrade refunds, or refunds for months unused with an open account.
• All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities unless stated otherwise. The Client is responsible for payment of all applicable taxes.
• GST is levied on every purchase as per applicable law and government notification.
• Downgrading your Service may cause loss of Content, features or capacity of your Account. The Service Provider does not accept any liability for such loss.
• Payment is considered complete only on receipt of the amount to Agam Technologies' designated bank account.
• In case of cheque payment, billing will be activated once the cheque is cleared.
• In case of cheque bounce, an INR 500 fine will be charged.
• Agam Technologies reserves the right to modify the fee structure by providing 10 days prior notice via the website or email.

Cancellation and Termination

1. It is your responsibility to ensure that your account has been properly cancelled. An arbitrary email requesting cancellation is not considered definitive.
2. All of your Content will be immediately and permanently deleted from the Service should you initiate cancellation. This information is irretrievable once deleted.
3. Your cancellation will be effective immediately once initiated. You will not be charged again from that point forth.
4. Agam Technologies has the right to suspend or terminate your account and refuse any and all current or future use of the Service for any reason at any time.
5. Agam Technologies reserves the right at any time, with or without notice, to modify or discontinue the Service temporarily or permanently.
6. Non-payment of fees for a continuous period of 2 months gives Agam Technologies the right to discontinue Services and delete all information in your Account.
7. The Service Provider, in its sole discretion, may suspend or terminate your account at any time for any reason, resulting in deactivation or deletion of your Account and forfeiture of all content within it.

Modifications

• The Service Provider reserves the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.
• Prices of all Services, including annual subscription plan fees, are subject to change upon 30 days notice by posting changes to agamedu.in or the Service itself.
• The Service Provider shall not be liable to you or any third party for any modification, price change, suspension or discontinuance of the Service.
• The form and nature of the Service may change from time to time without prior notice as the Service Provider is constantly innovating and improving the Service.
